NHRC order: 
 

This proceeding shall be read in continuation of the earlier proceedings dated 5th June, 2013. Pursuant to the show cause notice issued by the Commission, the Collector & DM, Balasore, Odisha has intimated vide his report dated 31.7.2013 that an FIR No.33 u/s 354 and 506 IPC was lodged by the victim on 7th August, 2012 regarding the incident. The matter was under investigation.

It was further informed that on enquiries made by the Sub Inspector of Police, Behrampur and Ajodhya Circle it was found that the allegation of sexual harassment made against the teacher Fatu Manjhi stood proved. Accordingly, the teacher was suspended and a departmental enquiry was started against him. He admitted the allegation of violation of human rights of the victim. 
 
Vide another report dated 19.8.2013, the Collector & DM, Balasore has admitted that it is a clear case of violation of Human Rights of the victim girl and that the victim girl deserves compensation/monetary relief as stipulated u/s 18 of the PHR Act. 
 
The Commission, after considering the facts and circumstances of the case and the findings arrived at by the Inquiry Officer, recommends to the State Government of Odisha through its Chief Secretary to pay a sum of Rs.3,00,000/- (Rupees Three Lakhs) as monetary relief/compensation to the victim girl Meena( name changed) through her father at an early date. A report of payment along with proof be sent within six weeks positively. The DM & Collector, Balasore and SSP Balasore, Odisha are also directed to intimate the final outcome of Cr.No.33 of PS Berhampur and also the result of departmental action/proceedings against the delinquent teacher.
